Terms & Conditions

Subject to the terms and conditions as set out below you will, as a member of the Defend My Licence Scheme, be entitled to specialist advice and assistance, by telephone, in respect to any issues relating to motoring offences.

The following conditions will apply:-

  1. Unless stated otherwise, the following terms shall mean:-
    Advice
    Any advice provided by the Advisers relating to any motoring issue or offence
    Appointed Advisers
    Solicitors/Barristers or such other legally qualified persons appointed to give advice under the Scheme
    Service Agreement
    The agreement completed and signed by the Participant overleaf subject to these terms and conditions
    Fee
    The cost of getting advice as set out in the Service Agreement
    Participant
    The person or persons named as a member(s) on the Service Agreement
    Transaction Code
    The unique code for individual transactions
    Scheme
    The Defend My Licence Scheme under the terms and conditions as set out below
    Service
    The services available, with set fees structure

  2. The Scheme
    1. For the duration of time as specified by the services paid for, the Participant shall be entitled to Advice from the Appointed Advisers.
    2. Prior to any Advice being given by the Appointed Advisers the Participant must pay the amount specified for that particular service(s).
    3. Any legal representation which may be required by any Participant anywhere in England and Wales shall be paid for independently of the Advice Fee but shall be arranged by the Service Provider (wherever possible) at a reduced hourly charge rate.
    4. The Service Provider reserves the right to cancel the Participant’s membership of the Scheme in the event that the Participant has in any way acted dishonestly, fraudulently, committed any breach of the terms of the Scheme or has permitted the use of the Scheme by an unauthorised person. In such circumstances the Participant shall not be entitled to any refund of the Fee.
    5. In the event of any withdrawal or suspension the Service Provider shall refund to the Participant the Fee on a pro rata basis but shall not otherwise be liable for any other claim howsoever arising. In such circumstances the Service Provider shall provide the Participant with no less than 30 days’ notice of the withdrawal or suspension of the Scheme.
    6. The Service Provider shall not be responsible for any advice or legal representation provided under the scheme which shall be the responsibility of the Appointed Advisers or the legal representatives appointed to represent the Participant in whatever capacity.
    7. To the extent as permitted under statute or regulation relevant to the operation of the Scheme the Service Provider strictly excludes the Service Provider’s liability (whatsoever or howsoever arising) to the Participant under the Scheme and in the event of the Service Provider being liable in any respect under the Scheme such liability shall be limited to the value of the Service Fee.
  3. Service Fees
    1. The Service Fee as set out in the Member Agreement shall entitle the Participant to the Service(s) of the Scheme for a period of time described in the Service itself.
    2. The Service Fee shall be payable immediately by way of debit or credit card.
    3. In the event of default of payment, the Service Provider reserves the right to terminate the Participant’s membership of the Scheme with immediate effect.
  4. Miscellaneous
    1. Any personal data obtained by the Service Provider pursuant to the Scheme shall be dealt with in accordance with the Data Protection Act 1998 and any statutory modifications or Regulations relating thereto.
    2. In accordance with the terms of the Service Agreement the Participant shall be entitled to opt in to allow the data held by the Service Provider to be passed to third parties.
    3. If any term, clause or provision of these terms and conditions shall be adjudged to be invalid for any reason whatsoever by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause or provision. Such invalid term, clause or provision shall be deemed to have been deleted from these terms and conditions, so as to give the remaining term, clause or provision effect.

This Scheme shall be operated in accordance with English law and shall be subject to the jurisdiction of the English courts.
